ONTARIO GOVERNMENT LEGISLATION UPDATE- EXECUTION OF WILLS DURING COVID-19

Like many, we have struggled to figure out how to get our clients’ Wills executed while complying with the necessary social distancing directive.  Until today, it has been necessary for the Will-maker and two witnesses (who, among other things, are not beneficiaries under the Will) to be in the physical presence of one another at the time of signing of the Will.   

The Ontario Government addressed this concern by recently amending the legislation, and for the duration of the COVID-19 crisis, Wills may now be signed in front of a lawyer and another witness via a recorded video- conference.
